航空事故

航空法上の事故は、以下に分類される。

1. 航空事故
2. 航空重大インシデント

第二条　この法律において「航空事故」とは、航空法（昭和二十七年法律第二百三十一号）第七十六条第一項各号に掲げる事故をいう。
２　この法律において「航空事故等」とは、次に掲げるものをいう。
一　航空事故
二　航空事故の兆候（航空事故が発生するおそれがあると認められる国土交通省令で定める事態をいう。）

第七十六条　機長は、次に掲げる事故が発生した場合には、国土交通省令で定めるところにより国土交通大臣にその旨を報告しなければならない。ただし、機長が報告することができないときは、当該航空機の使用者が報告しなければならない。
一　航空機の墜落、衝突又は火災
二　航空機による人の死傷又は物件の損壊
三　航空機内にある者の死亡（国土交通省令で定めるものを除く。）又は行方不明
四　他の航空機との接触
五　その他国土交通省令で定める航空機に関する事故

第百六十五条の三　法第七十六条第一項第五号の国土交通省令で定める航空機に関する事故は、航行中の航空機が損傷（発動機、発動機覆い、発動機補機、プロペラ、翼端、アンテナ、タイヤ、ブレーキ又はフェアリングのみの損傷を除く。）を受けた事態（当該航空機の修理が第五条の六の表に掲げる作業の区分のうちの大修理に該当しない場合を除く。）とする。

Accident. An occurrence associated with the operation of an aircraft which takes place between the time any person boards the aircraft with the intention of flight until such time as all such persons have disembarked, in which:
a) a person is fatally or seriously injured as a result of:
— being in the aircraft, or
— direct contact with any part of the aircraft, including parts which have become detached from the aircraft, or
— direct exposure to jet blast,
except when the injuries are from natural causes, self-inflicted or inflicted by other persons, or when the injuries are to stowaways hiding outside the areas normally available to the passengers and crew; or
b) the aircraft sustains damage or structural failure which:
— adversely affects the structural strength, performance or flight characteristics of the aircraft, and
— would normally require major repair or replacement of the affected component,
except for engine failure or damage, when the damage is limited to the engine, its cowlings or accessories; or for damage limited to propellers, wing tips, antennas, tires, brakes, fairings, small dents or puncture holes in the aircraft skin; or
c) the aircraft is missing or is completely inaccessible.
Note 1.— For statistical uniformity only, an injury resulting in death within thirty days of the date of the accident is classified as a fatal injury by ICAO.
Note 2.— An aircraft is considered to be missing when the official search has been terminated and the wreckage has not been located.

重大インシデントについて, JCAB

第七十六条の二　機長は、航行中他の航空機との衝突又は接触のおそれがあつたと認めたときその他前条第一項各号に掲げる事故が発生するおそれがあると認められる国土交通省令で定める事態が発生したと認めたときは、国土交通省令で定めるところにより国土交通大臣にその旨を報告しなければならない。

第百六十六条の四　法第七十六条の二の国土交通省令で定める事態は、次に掲げる事態とする。
一　閉鎖中の又は他の航空機が使用中の滑走路からの離陸又はその中止
二　閉鎖中の又は他の航空機が使用中の滑走路への着陸又はその試み
三　オーバーラン、アンダーシュート及び滑走路からの逸脱（航空機が自ら地上走行できなくなつた場合に限る。）
四　非常脱出スライドを使用して非常脱出を行つた事態
五　飛行中において地表面又は水面への衝突又は接触を回避するため航空機乗組員が緊急の操作を行つた事態
六　発動機の破損（破片が当該発動機のケースを貫通した場合に限る。）
七　飛行中における発動機（多発機の場合は、二以上の発動機）の継続的な停止又は出力若しくは推力の損失（動力滑空機の発動機を意図して停止した場合を除く。）
八　航空機のプロペラ、回転翼、脚、方向舵だ、昇降舵だ、補助翼又はフラップが損傷し、当該航空機の航行が継続できなくなつた事態
九　航空機に装備された一又は二以上のシステムにおける航空機の航行の安全に障害となる複数の故障
十　航空機内における火炎又は煙の発生及び発動機防火区域内における火炎の発生
十一　航空機内の気圧の異常な低下
十二　緊急の措置を講ずる必要が生じた燃料の欠乏
十三　気流の擾じよう乱その他の異常な気象状態との遭遇、航空機に装備された装置の故障又は対気速度限界、制限荷重倍数限界若しくは運用高度限界を超えた飛行により航空機の操縦に障害が発生した事態
十四　航空機乗組員が負傷又は疾病により運航中に正常に業務を行うことができなかつた事態
十五　物件を機体の外に装着し、つり下げ、又は曳航している航空機から、当該物件が意図せず落下し、又は緊急の操作として投下された事態
十六　航空機から脱落した部品が人と衝突した事態
十七　前各号に掲げる事態に準ずる事態

Serious incident. An incident involving circumstances indicating that there was a high probability of an accident and associated with the operation of an aircraft which, in the case of a manned aircraft, takes place between the time any person boards the aircraft with the intention of flight until such time as all such persons have disembarked, or in the case of an unmanned aircraft, takes place between the time the aircraft is ready to move with the purpose of flight until such time as it comes to rest at the end of the flight and the primary propulsion system is shut down.
Note 1.— The difference between an accident and a serious incident lies only in the result.
Note 2.— Examples of serious incidents can be found in Attachment C.

事故や関連したオペレーションになる可能性が極めて高い状況を含む事象のこと。有人機の場合は、フライトのために乗り込んでから降りるまでの間に起きるもの。無人機の場合は、航空機が飛行の目的で移動する準備ができてから、飛行の終わりに停止して主推進システムが停止するまでの間に行われるもの。
注1—事故と重大な事故の違いは結果のみにあります。
